A CNN guest said Tuesday that the Supreme Court “saved Joe Biden from himself” by requiring Title 42, a provision concerning the U.S. border, to be upheld.
The Trump-era public-health policy was ordered to stand in a 5-4 ruling, pending arguments scheduled for February.
Those opposing the decision were Associate Justices Neil Gorsuch, Sonya Sotomayor, Elena Kagan, and Ketanji Brown Jackson.
“The Supreme Court, at least temporarily, saved Joe Biden from himself. His administration was in court arguing to end this,” Scott Jennings, a former senior adviser to Sen. Mitch McConnell (R-KY), said when appearing on CNN. “They even admitted in court, the solicitor general admitted, that lifting Title 42 will lead to disruption and a temporary increase on unlawful border crossings. And we already have a massive number of people coming across anyway. The Supreme Court here did them a favor.”
While the above video shows a seemingly tense exchange between Jennings and others on the CNN panel, the former McConnell adviser does appear to be good friends with people on the network:

Jennings alleged the ruling was a “big political win” for over a dozen Republican attorneys general, led by Mark Landry of Louisiana and Mark Brnovich of Arizona, who requested federal courts block a ruling from U.S. District Judge Emmet Sullivan that would have terminated Title 42 beginning Dec. 21.
Illegal aliens have been entering the United States in record numbers. The United States Customs and Border Patrol (CBP) reported dealing with more than 2.3 million migrants in the Fiscal Year 2022, an additional 230,000 in October, the first month of the new fiscal year, with 600,000 migrants who manage to avoid CBP, per Fox News.
“They’ve said the border is secure, that’s not true. The White House press secretary has said, ‘oh, it’s not like they walk across, that’s not true,’” argued Jennings. “It’s been dishonest statements after dishonest statements.”
The former McConnell adviser is not alone in his belief that illegal immigration is out of control; a recent CNN podcast revealed that former President Bill Clinton suggested that an endless influx of migrants brings a nation massive issues.
“There is a limit to how many migrants any society can take without severe disruption and assistance, and our system is based much more on an assumption that things would be more normal,” Clinton said.
